Geographic Reassignment

A bill to restrict geographic reassignments, which passed both houses of the Legislature, has been sent to the Governor.  Take action now and ask that he sign it!

Subject: Geographic Reassignment Bill

Dear [ Decision Maker ] ,

As a Management/Confidential state employee and member of OMCE, The Organization of NYS Management/Confidential Employees, I am writing to ask that you sign S6652, which will limit the involuntary geographic reassignment of employees covered under Civil Service Law.

Under current law, public employees may be involuntarily reassigned without consideration of their years of service to the state. While this bill does not prohibit reassignments, it would require that, if employees are to be reassigned outside of the county or a contiguous county in which they currently work, that volunteers are solicited first and then, if reassignment is involuntary, that seniority be used as the criteria for reassignment. This is a reasonable process and consistent with the management practices recommended by the Department of Civil Service.

I am asking that you sign this legislation to establish a fair and objective procedure when determining geographic reassignment.

Background Information

Under current law, management has a great deal of discretion in determining involuntary geographic reassignments. This opens the door to favoritism and abuse, such as for example, a civil servant being reassigned because he or she is has fallen out of favor with management. If involuntary reassignment to another geographic location is necessary, then it is important that there be fair criteria in place to ensure objectivity.
