Today, we took an important step towards restoring balance and fairness to our economy - the Employee Free Choice Act was introduced in BOTH the Senate and the House of Representatives.

But with both houses of Congress now considering the bill, there's no time to waste.

Talking Points

The Employee Free Choice Act is critical legislation that will restore our middle class and give workers back the freedom to bargain for a better life. The mission to restore our middle class has never been more important than it is right now.

  • The introduction of the bill in both the Senate and the House so early is an indication that Congress is ready to move forward with the legislation. They are confident that the bill has the support in both chambers to go to the President's desk and become the law of the land.
  • Senators, Representatives, and working people are joining together to show broad support for the Employee Free Choice Act and calling on the president and Congress to make it law. According to recent polling, 73% of the public supports the Employee Free Choice Act.

Doesn't the number of cosponsors show that you don’t have enough votes to pass this bill?

  • Cosponsors and votes are two different things. Most legislation that is introduced in the House and Senate does not have a majority of Senators or Representatives—we strongly believe that there are the votes to make the Employee Free Choice Act law.

But you have fewer cosponsors than you did in 2007?

  • This is a different environment than in 2007. The business community is mounting a several hundred million dollar campaign to oppose this critical legislation. Every out-of-work GOP operative is using the Employee Free Choice Act as a rallying cry.
  • We firmly believe that every Senator who voted for cloture in 2007 is still on board.
  • The Employee Free Choice Act was introduced today because Congress and the public are ready for this legislation to land on the president’s desk and become law.

Does the Employee Free Choice Act eliminate the secret ballot election?

  • No.  The Employee Free Choice Act simply lets the workers decide—not the company—whether to form their union through a majority sign up or an election.   Workers can still have an election if they want one—though these company-dominated elections are nothing like what you and I are used to when we go to vote in November.
