Veto the New Overtime Rules

On August 23, 2004, the Bush Administration issued new rules to change the Fair Labor Standard Act (FLSA) regulations governing overtime provisions, the foundational labor law enacted in 1938 to protect the rights of workers. These changes make it much easier for employers to reclassify workers from 'non-exempt' to 'exempt', making them ineligible for overtime. In addition, the new rules undermine the 40-hour workweek and amount to a pay cut stripping overtime pay from at least 6 million workers. The full House and the Senate Appropriations Committee voted to rescind the new rules; however, President Bush has stated emphatically that he will veto any legislation reaching his desk that includes this language. Members, and their families and friends are urged to continue the fight against these new rules by sending a letter to their congressional representatives.

Dear [ Decision Maker ] ,

As my duly elected Senator, I urge you to support Senator Harkin's amendment barring DoL enforcement of the agency's recently passed overtime rules.

The Senate Appropriations Committee passed the amendment by a vote of 16-13, mirroring language passed by the House of Representatives on September 9. Senator Harkin's amendment would also rescind the new rules while protecting the minimum salary threshold, $23,660, for workers to receive overtime pay.

Your support of the Harkin Amendment can stop the Bush Administration's massive pay cut to at least 6 million workers. Again, I urge you to support the Harkin Amendment.
